How Discernment for Hire handles personal information through this Website and during the Inquiry and pre-engagement process.
Introduction and Scope
Discernment for Hire LLC (“DFH,” “we,” “us,” or “our”) respects the privacy of people who visit Discernmentforhire.com (the “Website”), submit an Inquiry, or otherwise communicate with DFH before a client relationship is established. This Privacy Policy explains the categories of personal information DFH may collect or process through the Website and pre-engagement communications, how that information may be used and disclosed, and the choices and rights that may apply.
This Privacy Policy applies to information handled through the Website and in connection with Inquiries and other pre-engagement communications with DFH. Once information is handled as part of an actual DFH client engagement—including a Private Consigliere or Bounded Private Consigliere Initial Assessment Period, Private Consigliere relationship, Bounded Private Consigliere engagement, Limited Advisory engagement, or other DFH client engagement—its handling may also be governed by the applicable engagement agreement, confidentiality agreement, DFH’s engagement-specific information-handling practices, or other written terms.
This Privacy Policy is a privacy notice. It does not itself create a client relationship, professional relationship, fiduciary relationship, or contractual obligation merely because the Website Terms of Use refer to it.
Information DFH Collects
Information You Provide
DFH may collect personal information that you voluntarily provide, including your name, email address, telephone number, organization, the capacity in which you are contacting DFH, the DFH relationship you are considering, timing information, and the information you choose to include in an Inquiry or other communication.
The initial Inquiry process is not intended for highly sensitive documents or information that should be shared only after appropriate confidentiality or security protections are in place. Please provide only what DFH reasonably needs to understand why you are reaching out.
Technical and Usage Information
When you use the Website, DFH and the service providers supporting the Website may automatically process limited technical and usage information, such as IP address, browser or device information, request and access information, referring or requested pages, timestamps, and similar information generated through ordinary website, hosting, security, caching, and server operations.
When an Inquiry is submitted, the Website also processes limited technical information for security and abuse prevention. For example, the current Inquiry system uses a derived representation of the submitting IP address temporarily to enforce a short anti-abuse rate limit. DFH does not use that mechanism to create a WordPress record containing the substantive contents of the Inquiry.
Information From Other Sources
DFH may also receive information about a prospective client or matter from a representative, referral source, organization, publicly available source, or other person where appropriate. The information DFH receives depends on the circumstances and does not by itself establish a client relationship.
Inquiry and Pre-Engagement Information
An Inquiry is preliminary. Submitting an Inquiry, joining a waiting list, communicating with DFH, participating in preliminary discussions, or providing information does not by itself create a client relationship or require DFH to accept an engagement.
Before a client relationship exists, communications are not governed by the same contractual confidentiality obligations that may apply after DFH and a client enter into appropriate written terms. Do not submit highly sensitive information, privileged material, sensitive documents, account credentials, or information that should be transmitted only through a protected channel unless DFH has established appropriate protections for receiving it.
If discussions advance, DFH may establish additional confidentiality terms, secure communication methods, or other protections before more sensitive information is exchanged.
How DFH Uses Personal Information
DFH may use personal information to operate, maintain, secure, and improve the Website; receive, review, evaluate, and respond to Inquiries; communicate with prospective clients and authorized representatives; determine whether and how DFH may consider a proposed relationship; maintain appropriate business and legal records; prevent misuse, fraud, spam, or security incidents; comply with legal obligations; protect DFH, its clients, prospective clients, and others; and support ordinary administrative and business operations.
DFH may also use information in other ways disclosed at the time of collection or with appropriate authorization.
Cookies and Similar Technologies
DFH and the technologies supporting the Website may use cookies or similar technical mechanisms where necessary or appropriate for website functionality, security, caching, preferences, or related operations. The specific technologies used may change as the Website and its supporting infrastructure change.
DFH does not currently intentionally use cookies or similar technologies for behavioral advertising or cross-site tracking. If DFH materially changes its use of such technologies, this Privacy Policy and any consent mechanism required by applicable law will be updated as appropriate.
Your browser may allow you to control or delete cookies. Restricting technical cookies may affect some Website functionality.
How and Why Information May Be Disclosed
DFH does not disclose personal information merely for publicity or casual commercial use. Personal information may be disclosed when reasonably necessary to operate the Website or business, evaluate or respond to an Inquiry, obtain services from providers supporting DFH, comply with law or legal process, protect rights or safety, investigate misuse or security issues, complete an authorized business transaction, or carry out another purpose disclosed to you or authorized by you.
DFH does not authorize the sale of Inquiry information as a business model or the use of Inquiry information for third-party behavioral advertising.
Service Providers and Third-Party Technology
DFH uses service providers and technology vendors to operate and support the Website and its communications and business infrastructure. Depending on the function involved, these providers may support services such as website hosting, content management, caching and performance, security, email delivery and hosting, technical maintenance, and other operational functions.
These providers may process information to the extent reasonably necessary to provide their services, maintain security and reliability, comply with law, or perform other functions permitted by their applicable terms and DFH’s arrangements with them. DFH seeks to use providers and configurations appropriate to the sensitivity and purpose of the information involved.
Because technology vendors and infrastructure can change, this Privacy Policy describes categories and purposes rather than serving as a permanent inventory of every software component used by DFH.
Artificial Intelligence and Automated Technology
DFH may use artificial intelligence, automated technology, research tools, or other technology to support limited business, research, administrative, drafting, organizational, or analytical functions where appropriate. Use of such technology does not replace Créole’s independent human judgment, verification, or responsibility for DFH’s work.
Nothing in this Privacy Policy grants unrestricted authorization to place confidential client information, highly sensitive prospective-client information, or protected materials into third-party AI systems. DFH does not treat information submitted through the Website as automatically authorized for third-party general model training. The use of confidential client information with AI or other third-party systems may be subject to additional engagement terms, safeguards, anonymization, consent, or restrictions appropriate to the circumstances.
Data Retention and Deletion
DFH retains personal information only for as long as reasonably appropriate for the purpose for which it was collected and for legitimate legal, security, recordkeeping, dispute, business, or compliance needs.
Substantive personal information from an Inquiry that does not result in a client relationship will ordinarily be deleted within 12 months after the Inquiry or consideration process has concluded, unless a longer period is reasonably necessary for legal, security, recordkeeping, dispute, or other legitimate purposes. Limited records may be retained where reasonably necessary to document communications, decisions, legal acknowledgments, or other legitimate business matters.
Technical security and anti-abuse information may be retained for substantially shorter periods where appropriate to its function. For example, the current Inquiry rate-limit mechanism uses temporary anti-abuse state that ordinarily expires after approximately five minutes. Hosting, email, security, backup, and server systems may maintain separate technical records according to their own operational retention cycles.
Information connected with an actual DFH client engagement, including an Initial Assessment Period, may be subject to different retention and preservation requirements established by the applicable engagement terms, legal obligations, or DFH’s engagement-record practices. Those engagement-specific requirements are separate from the Website, Inquiry, and pre-engagement retention practices described above.
Information Security
DFH uses reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, use, alteration, loss, or disclosure. Measures may include access controls, protected accounts and devices, encrypted transmission where supported, security and caching infrastructure, restricted administrative access, and other safeguards appropriate to DFH’s operations.
No website, email system, transmission method, storage system, or security measure can be guaranteed to be completely secure. You should use appropriate care when transmitting sensitive information and follow any secure-channel instructions DFH provides.
Your Privacy Rights and Choices
Depending on where you live and the law that applies, you may have rights concerning personal information DFH maintains about you, which may include rights to request access, correction, deletion, or other information about DFH’s handling of your personal information.
You may also choose not to provide optional information, although doing so may limit DFH’s ability to evaluate or respond to an Inquiry. Where consent is the basis for a particular processing activity, applicable law may permit you to withdraw that consent prospectively.
To make a privacy request, contact DFH using the privacy address in Section 19. DFH may take reasonable steps to verify your identity and authority before fulfilling a request. Privacy rights and deletion requests are subject to applicable law and may be limited where DFH is permitted or required to preserve information for legal obligations, claims or disputes, security or fraud prevention, recordkeeping, or other legitimate purposes.
U.S. State Privacy Rights
Some U.S. state privacy laws provide residents with specific rights and disclosures depending on factors such as the person’s state, the type of information involved, and whether the law applies to the business processing the information.
Where an applicable law gives you a privacy right, DFH will address a properly submitted request as required by that law. DFH does not represent that every state privacy statute applies to DFH merely because a resident of that state visits the Website.
International Visitors
DFH is based in the United States. If you access the Website or communicate with DFH from outside the United States, your information may be processed in the United States or other locations where DFH’s service providers operate. Privacy laws in those locations may differ from the laws where you live.
If DFH undertakes a client relationship requiring additional international data-transfer, privacy, or contractual protections, those requirements may be addressed separately as appropriate to the actual relationship and jurisdictions involved.
Children and Age Restriction
The Website is intended only for adults who are at least 18 years old. DFH does not knowingly invite or solicit personal information through the Website from children under 18.
If DFH learns that personal information was submitted through the Website by a person under 18 in circumstances where it should not have been collected, DFH may take reasonable steps to delete or otherwise address that information.
Third-Party Websites and Services
The Website may link to websites, platforms, resources, or services operated by third parties. DFH does not control those third parties’ privacy, security, content, or data-handling practices. Your interaction with a third-party service is governed by that service’s own terms and privacy practices.
Legal Requirements, Protection of Rights, and Compelled Disclosure
DFH may preserve, use, or disclose information when reasonably necessary to comply with applicable law, regulation, subpoena, court order, governmental demand, preservation obligation, or other lawful process; to establish, exercise, or defend legal rights; to investigate suspected fraud, misuse, or security incidents; or to protect the rights, property, safety, confidentiality, or legitimate interests of DFH, its clients, prospective clients, or others.
Where legally permitted and reasonably appropriate, DFH may seek to limit or challenge overbroad demands or provide notice to an affected person. Nothing in this Privacy Policy promises notice where notice is prohibited, impracticable, or inappropriate.
Business or Organizational Changes
If DFH is involved in a merger, acquisition, reorganization, financing, sale of assets, restructuring, succession, dissolution, or similar business or organizational change, information may be reviewed, transferred, preserved, or otherwise handled as reasonably necessary in connection with that event, subject to applicable law and appropriate confidentiality considerations.
Changes to This Privacy Policy
DFH may revise this Privacy Policy as its Website, technology, business practices, or legal obligations change. The version posted on the Website will identify its Effective Date and Last Updated date.
Changes apply prospectively from the applicable effective date unless law requires otherwise. DFH may provide additional notice of material changes where appropriate. Changes to this Website Privacy Policy do not by themselves amend a separate signed client agreement, confidentiality agreement, or other contract.
DFH may preserve prior versions or other records reasonably necessary to document which privacy notice was in effect at a particular time.
